PRESIDENT OBAMA YOU GOT YOUR HOUSE BACK GET OURS BACK



Dear Mr. Obama,

We gave you and your family your house back and we respectfully ask that you do same for us.  Please get our homes back from the banks and stop foreclosures in our America. 

Foreclosures are at an all time high.  We continue to lose our homes to banker greed.  We are in great need of your intervention.  We are confident that you have the ability to re-evalute the housing issues, take a stand against the bankers and do the right thing for the American homeowners.  Please stop foreclosures in our America.

FORECLOSURE VS ADVERSE POSSESSION ......SWEET




Bank of (America) Antichrist called.   EURICE one of the devils spawns asked what I planned to do about my loan.  Modify my loan.   I explained the debacle that created this mess to begin with.   The devil’s spawn, EURICE again asked what I planned to do with my home.  Modify it, clearly she did not understand.  The devil’s spawn mumble something to the effect of “modification is not a guarantee.”   At which point I expressed my disappointment with Ken Lewis, Brian Moynihan and that ugly women, Barbara Desoer suggesting they be imprisoned.   That probably did not sound good on the Bank of Antichrist “recording.”
Again EURICE asked what I planned to do.  So I said, well I have so many options.  I can let you foreclose, I can file for bankruptcy, I can short sale, I may set up Occupy My Condo………or……most likely, I may take ADVERSE POSSESSION of a home that Bank of Antichrist foreclosed on.   “I will not take adverse possession of an $81,000 condo but I will take adverse possession of a $400,000 or $500,000 home.”  I figure it is only fair that if Bank of Antichrist takes my home from me, I will take adverse possession of one of their expensive homes.  I am not recommending this as it may not fit your style.  But if you are interested in adverse possession please check with a lawyer regarding the laws in your state so you are in compliance and are able to make an impact on Bank of Antichrist.

ADVERSE POSSESSION:   A method of gaining legal title to real property by the actual, open, hostile, and continuous possession of it to the exclusion of its true owner for the period prescribed by state law.  Title to land is acquired by adverse possession as a result of the lapse of the Statute of Limitations for Ejectment, which bars the commencement of a lawsuit by the true owner to recover possession of the land. Adverse possession depends upon the intent of the occupant to claim and hold real property in opposition to all the world and the demonstration of this intention by visible and hostile possession of the land so that the owner is or should be aware that adverse claims are being made.   Adverse possession consists of actual occupation of the land with the intent to keep it solely for oneself. Merely claiming the land or paying taxes on it, without actually possessing it, is insufficient. Entry on the land, whether legal or not, is essential. A Trespass may commence adverse possession, but there must be more than temporary use of the property by a trespasser for adverse possession to be established. Physical acts must show that the possessor is exercising the dominion over the land that an average owner of similar property would exercise. Ordinary use of the property—for example, planting and harvesting crops or cutting and selling timber—indicates actual possession. So EURICE, you see I have a plan.  You should have one also, like resign your position as one of the devils spawns because ultimately, Bank of Antichrist will have to answer to lawsuits, the government and the public.  We can’t wait!     



MIAMI-DADE VOTER FRAUD OR JUST A MISTAKE?

I blogged a couple of blogs ago regarding an article written by Evan M. Rosen urging voting against your elected officials that voted in favor for SB1890 and HR213 bills the “Fair Foreclosure Act.  In following up, I determined which elected officials voted in favor of these bills and I set out to vote against them.   How foolish of me to think that I would be able to do something that is within my Constitutional Rights.



On Friday, October 26, I called the Miami-Dade County Elections Department to inquire about my voter registration card and license having different addresses.  I was informed by the man with whom I spoke that I would have no problem voting.  Regardless of the address issue, early voting gave me the opportunity to vote at any site I choose, removing the issue of having to vote at a specific location.  The person I spoke with did not ask for my name, voter id number or any other information. 

Upon arriving at voting site 5050 W Flagler Street, Miami, Florida, I was informed that I was removed from the voter registration lists.  WHY?  This is how it basically played out.  Olyme Moreno, asked for my driver’s license, checked me in her computer system and informed me that I was removed from the list.   Olyme requested my voter’s registration card, which I provided.   Unable to find me, again she insisted that Miami-Dade County Elections had removed my name from the list.  “Sorry” the most I could do was to have a “provisional ballot” and “if the elections department decided I was not eligible to vote they would throw out my vote.”  WHY?   Olyme then realized that I had moved noting that was the reason they removed me from voting.   WHAT?  The fact that I was honest about the change of residence was my doing.  If I would have given the Elections Department any acceptable identification that did not indicate my address, Olyme would not have known I had moved.  So tell me again Elections Department, WHY did you remove me from the voter registration list?  Kashira (sp?) the Elections Supervisor was informed of the problem and indicated that I had moved and that caused me to be removed from voting. 

No Kashira,that is not an acceptable excuse.  Tell the truth; the Elections Department mistakenly removed me from the voter registration list.   Period!

BANK OF AMERICA THE ANTICHRIST

Many things have been said about "BANK OF AMERICA," but this definition is the most perfect characterization for the vile and despicable BANK OF AMERICA, the ANTICHRIST.  Let's break it down. 

1) Bank of America has become the great personal opponent of American homeowners.  

2) Bank of America has spread evil throughout the "U.S."
  
3) Bank of America has yet to be conquered.  

   BANK OF AMERICA IS  THE ANTICHRIST!

Granted there are other banks along with the "ANTICHRIST" (BANK OF AMERICA) that have operated out of greed, making families homeless, sending them out onto the streets.  I would ask that you make all the big bad banks a.k.a. ANTICHRISTS have to look at your faces.


Please post your family pictures, name your banks and call them out.   Make the banksters aware you are more than your loan number.  Let them know you are a human being, you have a name, you have a heart that is breaking because of them,  a family that is sad, children that are fearful, parents that hurt for you, neighbors that realize they may be next and  friends that hope you win.  Post and tell the banksters that their children will sleep in their beds but yours will not.  Tell them their family has a beautiful home but your family is homeless because of their callous actions.   
The banks must be held accountable and this is a start.   Make your bank look at your face and see that your family's sadness is real.    Post pictures and tell your story here !

STANK (BANK) OF AMERICA SUED BY FEDERAL PROSECUTOR

I would urge Pam Bondi to take an aggressive stance against Bank of America.   Sue them on our behalves; make them compensate the State and homeowners.  Homeowners stand to receive in some cases between eight hundred to one thousand dollars compensation.  That is by no means compensation for the crimes committed against homeowners.  
The banks fraudulently foreclosed (among other acts) on homeowners adversely affecting the human populace.   HUMAN is the key word, Pam.  The word homeowner has become as faceless as their loan number but they are actually mothers, fathers, children, brothers, sisters, neighbors and friends.  The elderly and infirmed are devastated by their loss, men and women continue to become homeless and children are displaced.    

Pam, if a group of individuals conspired to fraudulently steal homes away from victims, you would relentlessly pursue and prosecute them for their crimes.  You would charge them with fraud, theft, conspiracy and a barrage of other charges.   The Banksters should be no different.   Stand up to the Banksters that perpetrated these crimes victimizing men, women and children.  Please remember the same victimized homeowners are your constituents and we need your commitment to do the right thing for Florida.

ELECTED OFFICIALS VOTE AGAINST HOMEOWNERS


I follow Foreclosure Attorney, Evan M. Rosen on Twitter.  I am unclear how I found his blog but, the information is useful and educational. 

Foreclosure Attorney, Evan M. Rosen wrote an article September 2012 regarding House Bill HB213 called the “Fair Foreclosure Act” that is intended to streamline the process of foreclosure and restrict homeowner’s rights.  This bill was passed 94-17.  This bill was not fair to homeowners but was very generous to the big  bad banks.  

As Mr. Rosen indicates, “94 of Florida’s elected officials voted to allow banks to kick Floridians out of their homes faster!”   He suggests that we check how our House Representative voted, so I did.  Even though the odds were against me, I thought I would check for myself.  Much to my displeasure I found that Nelson and Diaz both voted in favor of HB213.  Sadly these are our elected officials and their responsibility should be to their constituents / citizens.   Mr. Nelson and Mr. Diaz this time YOU FAILED US!  WE WILL VOTE AGAIN !

I also follow 4Closure Fraud on Twitter.  Again, I am unable to tell you how I began following them nor can I tell you who writes their blog.  I find them interesting, current and informative.  4Closure Fraud also wrote on the SB 1890, the same bill mentioned by Mr. Rosen HR(213).  The "Fair Foreclosure Act" did not pass Senate fortunately for us. 

The fact that it did not pass does not mean we can let our guards down.  We must call our elected officials  to voice our opinion and vote against the politicians that voted in favor of this law.  There is strength in numbers !    Please stand up and be counted !    VOTE it is your right !

  MORE MODIFICATION VS LESS MORTIFICATION



On September 1, 2012 The New York Times Sunday Review ran in an editorial entitled "Still No Justice  for Mortgage Abuse" that indicates we are nowhere near seeing the light at the end of tunnel in the foreclosure and mortgage mortification scandal.  Please see the excerpts from this editorial.

“It has been six months since the big banks settled with state and federal officials over evidence of widespread foreclosure fraud, promising to provide $25 billion in mortgage relief in exchange for not being sued over past foreclosure abuses.  The type of relief provided — mostly short sales, in which a bank allows a homeowner to sell for less than is owed on the mortgage — had become increasingly common before the settlement.  Short sales are better than foreclosures, in part because they prevent vacancies that depress house values. But they are not punishment for wrongdoing in any meaningful sense; rather, they allow banks to get higher prices for underwater properties than they could have gotten in foreclosure sales. Nor do they fulfill the settlement’s main purpose: to keep underwater borrowers in their homes by reducing the principal on their mortgage loans. According to the monitor’s report, $8.7 billion of debt has been written off in short sales versus only $750 million of principal reduction from loan modifications.  Even the relief that is provided may turn out to be less than meets the eye. That’s because much of the debt forgiven in short sales and loan modifications will be counted as taxable income to the borrowers, creating huge tax bills they will not be able to pay.” 

Banks continue to show irresponsibility/deceit towards the government in their lack of bailout to the homeowners.  Most importantly, the banks made an unprecedented legal maneuver carving out a shield of protection for themselves from the homeowners by restricting legal recourse for their wrong doings.

HOMEOWNERS BEWARE:  Short sale may place you in a precarious taxation position if your property is sold for less than you owe and the debt is “forgiven or written off” by your bank.   The amount that is “forgiven” by the bank is taxable by the IRS.   Your short sale my negatively impact you in the long run.  The bank is not telling you that you will be taxed on the money they "forgive."  It is not the bank's responsibility to educate the public. The bank will ultimately financially benefit from a short sale and you will have lost your home and be held responsible for taxes on the "forgiven mortgage."   The banksters just got away again!

BANK OF AMERICA LEAVES CHILDREN HOMELESS

Another Bank of America travesty of justice is playing out in a San Fernando Valley foreclosed home.  Ulises Hernandez requested several modifications on his loan.  Typically, Bank of America that continues doing business as usual painfully foreclosed on the Hernandez family home.   The family has chosen to fight against Bank of America. 

The Hernandez family refuses to leave their home and has created FortHernandez.  You can find them on Facebook at www.facebook.com/OccupySanFernandoValley.  Please support them. They have been in “occupy mode” for fifty three days and counting. 

The Hernandez family has been subjected to “visits” by code enforcement and the department of Children and Families.  They have been arrested.  It is illogical that Bank of America has committed fraud and the culprits, their employees, were not imprisoned.  The Hernandez family is facing harassment only because they want a modification on their beloved home and they refuse to be quieted or intimidated.

FORECLOSURE THE NEW “F" WORD



This era has seen its share of the “F” word.  When I say this, I am referring to “foreclosure.”  The new "F" word has become so popular that everyone knows someone that has fought or is currently fighting foreclosure, the new "F" word.   Sadly enough we will continue to see the “F” word until our elected officials hold accountable and imprison Bank of America’s Brian Moynihan, new CEO, Ken Lewis, Retired CEO and their bankster cronies.  Then we can go back to using the old "F" word but now that I think of it, when I see either of their pictures, I really want to say the old “F” word.

FINANCIALLY SUPPORTING YOUR OWN FORECLOSURE ?



My mortgage is held by Bank of America.  My personal checking, savings and my husband’s business (now closed) accounts are with Bank of America.   The same bank that holds my mortgage and my bank accounts  was found guilty of committing fraud (MERS) and more personally, fraud against me.  

I am financially supporting Bank of America's fight against me.   When I deposit my money into my accounts at Bank of America they use my money to pay for MERS, refuse to modify my loan (and yours) and ultimately take my home. 

Do the words modification and foreclosure pain you when you hear them?  Is your mortgage company and bank one in the same?  If you answered yes, please stop and analyze the following situation.   You are giving your predator enemy money to use against you in their plans to take your home away from you.   You would not give a thief the keys to your home or car as the thief will use them to rob you.  Your mortgage company is doing exactly that.   Bank of America is taking homes from homeowners and we are funding them by depositing money in their bank.  In my case I am funding a felon institution and my worst enemy to take my home away from me. 

BANK OF AMERICA, LISTEN CAREFULLY, I REFUSE TO BE YOUR VICTIM.  I WILL UTILIZE MY FIRST AMENDMENT RIGHTS TO SPEAK OUT AGAINST YOU.  I WILL NOT BE QUIETED BY FEAR, INTIMIDATION OR HUMILIATION.   I AM CLOSING MY ACCOUNTS AT BANK OF AMERICA.  I URGE EVERYONE THAT IS READING THIS TO DO THE SAME.

THERE MAY BE HOPE


There may be a smidgen of help on the foreclosure debacle.  It seems that some relief is available and is a few steps away for Tennessee.  Attorney General of Tennessee, Bob Cooper is giving away money, the amount is not indicated.  Homeowners from Ohio will see $840.00 per household.   This is little consolation in comparison to the homeowners loss.  Take a look below.

Foreclosure help notices being mailed in Tennessee 
NASHVILLE, Tenn. — Notices are going out in the mail to an estimated 37,000 Tennessee borrowers who may be eligible for payment under a $25 billion national mortgage foreclosure settlement. Eligible borrowers will be receiving claim forms in the mail this month and Attorney General Bob Cooper of Tennessee urged residents to complete the forms and return them by the Jan. 18, 2013 deadline. Those eligible include people who lost their homes to foreclosure between Jan. 1, 2008 and Dec. 31, 2011 to five of the nation's largest mortgage services, which is Ally/GMC, Bank of America Corp., Citi, JPMorgan Chase & Co., and Wells Fargo & Co. The packages will be mailed through Oct. 12.

The predator banks were paid handsomely for committing fraud and illegally stealing homes (robo-signing) from homeowners and taking a passive aggressive position on their agreement with the government as it relates to modifying loans.  Even when the home owners believe they are in the middle of a modification, the banks continues to pursue foreclosure, specifically Bank of America.  Looking at this from a bird's eye view, modification does not seem likely.  Do the banks (Bank of America) really want to modify?

WHISTLEBLOWER FIRED! BAD BANK OF AMERICA

Bank of America is a predator.  Truly the words BANK OF AMERICA sticks in many victimized homeowners throats when they think that their mortgage company desired financial greed and power over following the law, keeping their agreements with the government and doing the right thing for all involved. 
 
Another example how Bank of America is abusive in their dealings with the smaller less powerful public is how they fired the “whistleblower” that led internal investigations that found “pervasive wire, mail and bank fraud involving Countrywide employees,” September 14 (Bloomberg).  The investigation done by the U.S. Labor Department published their findings in a statement that indicates, “it’s clear from our investigation that Bank of America used illegal retaliatory tactics against this employee,” and “must be reinstated” and most importantly and appropriately, must be compensated.   Excellent!  Thank you “whistleblower” you are my hero!

Stand Strong Against Foreclosure Eviction


FORECLOSURE.   If this word sounds all too familiar to you please take time to tell your story to the world by leaving a comment on this site.  This blog is an attempt to bring attention to the injustice that plays out on a daily basis at predator banks, such as BANK OF AMERICA.  Your Big Bad Bank and its employees may have a different name or title but if you are trying to save your home from foreclosure, I can guarantee you are facing the same unfair, uneven playing field that millions of others agonize over daily.

Are you in the midst of losing your home to foreclosure?  Have you repeatedly tried to save your home to no avail?   Foreclosure and modification are painfully synonymous these days.  We need a resounding voice and a platform to stand up against all the Big Bad Banks that pursue foreclosure over modification resolution.   These predator banks were bailed out but we the homeowners were not.  Big Bad Banks are ruthless and abusive in regards to making decisions that ultimately could leave you homeless!  They are fully aware, that as homeowners we are easily quieted and taken advantage of.  We are small, financially challenged, emotionally drained and anguished by the fear of losing our homes.

We have a human story that must be told and a voice that will be heard.  We must speak up to bring attention to this terrible injustice.   Please join in spreading the word through all social media avenues that are available.  Name your bank and call out the employees that are jeopardizing your well being.  They rest at night, enjoy outings and have status in their communities.  Hold them publicly accountable.  Make their friends, family and community aware of the damage and hardship they causing.   Stand up, speak out and be heard.  There is power in numbers and together we can make a difference!

Death, divorce and loss of income lead me to request a refinance. Declined, “not making enough.”  I requested a modification, again BANK OF AMERICA declined, “making too much.”  Ran behind on my mortgage so I cashed in my 401K and two days after I got up to date, BANK OF AMERICA foreclosed on my home.  Their third party administrator or servicer failed to notify them in time.   I begged, pleaded, fought and tried to reason with everyone at BANK OF AMERICA.   They received the money; cashed the checks but it was not applied to the account and would not be.  I was losing my home.  MERS bit me, I was robo-signed.   I qualified for the US Department of Justice (DOJ) and State Attorney General global settlement program against BANK OF AMERICA. I applied for the DOJ program through CARLOS TORRES at the Dadeland office.   I was declined, "not enough money." I was unable to reach my Relationship Manager, LESLY RABOUIN (Ft. Lauderdale office) for two weeks. TASHA with BANK OF AMERICA called asking that I bring my mortgage up to date.    I explained that BANK OF AMERICA and I had the perfect opportunity for a relationship, they wanted money and I wanted to keep my home.  Please modify I insisted.   Sadly we could not reach an agreement.  TASHA sent an email to LESLY RABOUIN and he finally returned my calls.   Polite, well-spoken and seemingly knowledgeable, LESLY RABOUIN is very much in control of my destiny.   That is of no comfort.

BANK OF AMERICA fraudulently subscribed to “MERS” and ROBO sign foreclosures and they are not obligated to reverse the decision.   If we conspired to deceptively take someone’s home from them, there is no doubt in my mind that not only would we would be facing a jail term but the government would not bail us out!  So I propose all top bank officials, middle management and their underlings that participated in illegally foreclosing on homes, be jailed.

The bank bailout was myopic indeed.   No accountability, just free money for all.  For every foreclosure that takes place and modification or refinance that does not get approved, a fine should be levied against the predator banks that took government money and did not help anyone but themselves.  Shame on you BANK OF AMERICA and all your cronies at the other BIG BAD BANKS!
